General terms and conditions

  1. The contract shall remain in effect as per the agreement and will automatically renew unless terminated in writing no later than 30 days prior to the expiration of the agreement. The payment is to be made to the postal account 85-402068-9 Ferrer Dojo, Winterthur, and is due at the commencement of the contract. Any supplementary agreements and amendments to this contract shall be made exclusively in writing.
  2. By signing this contract, the student declares that they are in full possession of their physical and mental faculties and that they have no prior convictions for offenses against life and limb, nor are they involved in any ongoing related proceedings. Should these circumstances change during the contract term, the student must promptly notify the training supervisor. Liability on the part of Ferrer BJJ and/or Ferrer Dojo (Alberto Ferrer) is excluded in all cases.
  3. The student shall be trained in martial arts, specifically Brazilian Jiu-Jitsu, Gracie Jiu-Jitsu, Capoeira, Grappling, and/or MMA (Mixed Martial Arts), according to their abilities by the instructor or their authorized representatives. The learning outcomes are dependent on the individual conditions of the student and their training commitment and are not guaranteed. The training includes, among other things, movement forms and gymnastics, ground fighting, and stand-up defense.
  4. The student is obligated to use the learned skills solely in extreme emergencies for self-defense. All students must regularly review and adhere to the guidelines and instructions outlined in the “Dojo Etiquette”. The student may be immediately excluded from participation in the training for valid reasons, such as involvement in altercations or criminal activities, unsportsmanlike behavior, non-compliance with instructions, or disregard of the Dojo Etiquette. Paid fees will not be refunded, and any services already rendered must be paid for.
  5. FerrerBJJ and/or Ferrer Dojo commits to taking all precautionary measures to prevent accidents and injuries. The student trains at their own risk. Therefore, insurance is the responsibility of each individual student. Liability on the part of the course management, including non-contractual liability, for any damages incurred by the member during training sessions or through the use of our services, is excluded. Likewise, we are not liable for children under supervision, nor for the loss of personal clothing, valuables, money, etc.
  6. Training cancellations due to force majeure within the operational scope of FerrerBJJ and/or Ferrer Dojo (including, but not limited to, fire, building damage, illness, accident) will not be reimbursed. Non-utilization of FerrerBJJ’s and/or Ferrer Dojo’s services does not entitle the student to any refund or reduction of fees. In cases of pregnancy and compulsory military service, we grant a possible contract suspension.
  7. The relocation of the training facilities does not entitle the student to premature termination of the contract. The contract remains binding even in the event of a legal successor to the current course organization.
  8. The FerrerBJJ and/or Ferrer Dojo Academy will remain closed on public holidays. Operational interruptions (a minimum of five weeks per year) have been taken into account in our subscription prices. Therefore, no credits or fee reductions can be claimed. Student vacations will not be reimbursed.
  9. The training pass must be scanned on the tablet before the start of each visit. In case of loss, the replacement cost for the pass is CHF 20.00. The facilities are exclusively for the use of those holding a training pass during official class hours (subject to change) and must not be allowed to third parties.
  10. The student agrees to open or continue operating a BJJ, Grappling, or MMA school within a 30-kilometer radius of Winterthur only with prior written consent from Chief Instructor Alberto Ferrer. The name of the school is irrelevant; what matters is the similar or identical content of the lessons offered at the new school. These newly opened schools must indicate their affiliation with FerrerBJJ and/or Ferrer Dojo on their websites and in marketing efforts in an appropriate manner. This territorial regulation also applies for up to 5 years after the termination or dissolution of this contract for any other reason. In the event of a breach, a penalty of CHF 45,000.00 is to be paid immediately.
  11. Students of FerrerBJJ and/or Ferrer Dojo who participate in competitions are required to wear the FerrerBJJ and/or Ferrer Dojo logo on their Gi and during No Gi competitions. This applies especially to public appearances related to or in the context of competition events, such as interviews, award ceremonies, etc.
  12. Students of FerrerBJJ and/or Ferrer Dojo who are promoted to black belt commit to handling the name FerrerBJJ and/or Ferrer Dojo responsibly and respectfully in their future BJJ endeavors. When opening or continuing schools outside the territory as per Clause 10, they must indicate their affiliation with FerrerBJJ and/or Ferrer Dojo on their websites and in marketing efforts in an appropriate manner. Black belt graduates from FerrerBJJ and/or Ferrer Dojo expressly acknowledge that this is an enforceable claim lasting 8 years from the date of graduation. This regulation also applies in the event of termination or dissolution of this contract for any other reason.
  13. The place of jurisdiction is Winterthur. Exclusively Swiss law shall apply.
  14. The student agrees with the content of this contract.
